Penguin Update by Google – A Few Issues to Investigate When Affected by It

    July 30, 2012

A Short Introduction to the Issue:

As Google rolled out the Penguin update many sites globally were affected by a so-called “penalty” effect wherein Top Rankings disappeared, and sites that did not disappear from the organic search results lost their positioning.

    Was Everyone Affected?

Not really. Every site that lost its rankings was replaced by other sites which according to Google were not ‘Gaming’ the system. ‘Gaming,’ because the sites affected, suffered primarily because of the way they were optimized and how their links were built.

Does this mean that the way an affected site was promoted was bad?’ Let’s try to answer that with another question – Would this question been asked if that site had continued to enjoy top rankings?’

Here is what the Penguin Brought Along:

With the Penguin update, links that were given value and counted as a valid vote towards a website were treated to a much higher degree of evaluation. Backlinks pointing towards a site were also subjected to this. Being an algorithmic update, Penguin put every site through the test, and many sites lost their link sharing power as a result.

Wondering why your site lost its rankings? From all that is known about the Penguin update to date, lost rankings were mainly due to:

    1. The value of backlinks pointing towards your site was deprecated.

    2. Your site enjoyed ‘site-wide’ links from other sites.

    3. The backlinks to your site were mainly for your main keywords (considered quite normal till the Penguin update came about, although your SEO Consultant should have warned you of the importance of having a wider keyword base to target and gain traffic from. In most cases, if you had a smaller list of keywords/anchor text, then you were party to the decision as larger lists are usually accompanied with larger costs.)

As of now, it appears that the main reasons for lost rankings are all ‘off-page.’ So that is where you must begin to investigate.

‘On-Page’ factors too have been mentioned as a probable cause, but in most cases, if your site was ‘okay’ for the on-page before the Penguin update, it is safe for that factor now as well.

What You Will Need When Investigating Reasons:

    1. An extensive list of links pointing towards your site. Do-Follow links are what you need to worry about because no-follow links (even if they are site-wide backlinks) will not be the cause of any kind of a penalty.

    2. A list of anchor text and their respective number.

What to Look for and Possible Corrective Measures:

    1. Links from ‘banned’ sites: I don’t believe that the penalty for a link from a banned site is very high, unless you have links from a large number of banned sites like link / blog networks (you can however be affected by other kinds of penalties like those which are applied when a site is found to be participating in link-purchasing, etc.). In most cases, the worst effect of a minimal number of such banned links would be a drop in the link value that was shared with your site. Directories and content syndication site links too would not typically be very damaging, even if they are banned sites because the percentage of these would usually be very small.

    2. Site Wide links: This is an important factor to investigate. If found, you need to either remove these links or, if they are important to you as a traffic source, covert them to ‘no-follow’ links.

    3. Too many backlinks with the same anchor text: This should not have occurred in the first place, but if it has, then it is time to go about slowly creating a larger spread of keywords (you will only gain from it in the long run.)

Didn’t Find Anything From the Above?

This is bound to be the case for many websites and usually this would mean that many of the links which were until now sharing higher value/link-juice with your website have lost some or all of their value.

    Blaming Google?

This is common, though it’s a case of misdirected anger. Such an update has been long coming and most SEO Consultants were expecting some kind of a change/modification. In my personal opinion it is best to investigate and correct factors which are ‘today’ considered as web-spam instead of blaming Google and praying for a change/roll-back soon.

    Best of Luck!

Best Social Media Marketing Strategies for Small Business

    July 30, 2012

In this article we will look at the best social media marketing strategies to promote any small business on the internet.

    Social Media Viral Syndication

Social networking is the future of traffic. Google is starting to use social triggers more and more to help decide which content to rank on Google because it is harder to manipulate giving yourself backlinks from other people’s social networking accounts. But you can use social media to get traffic without having to rely on Google. Just post one interesting blog post with some informative tips and then go to a relevant Facebook Group and share the content.

Your competition will be low because everyone else will be posting spammy looking links, so if you simply write something like “Hey everyone, I have just posted this article that I think will help you in your business. What do you think?” then you will stand out from all the hype.

    Twitter Marketing

This free web traffic strategy does not rely on you having many Twitter followers. As part of this best free web traffic tip, simply post a link to your blog post in Twitter but use hashtags to have the Twitter search engine associate your tweet with relevant keywords. Many Twitter users request to be notified when a tweet comes in containing phrases they are interested in. So use your hashtags (#InternetMarketing, #Business etc.) wisely. Also, specifically request that people re-tweet your links to increase chances of viral syndication.

    TribePro

This social bookmarking service is like Ping.FM but taken to the next level. For every link you post, it will be shared via the social media accounts of many other marketers. This will create social backlinks from real social networking accounts with a variety of different IP addresses. TribePro operates under the “sharing the love” philosophy in the internet marketing world, whereby you
see other marketers as colleagues and not competitors.

Social media marketing is at its strongest when marketers share each other’s content without worrying about sending traffic to their “competitors.” *

    Viral Video Traffic

YouTube is considered to be a social networking website nowadays. YouTube is an interactive community that can generate web traffic directly from the internal YouTube search and on the main Google search. Videos are now listed along text based websites in Google for direct free search engine traffic. One trick to get social media traffic from YouTube is to embed a popular viral video that someone else has created into your own blog post (this is perfectly legal and ethical). And then share that blog post via Facebook and Twitter, but direct traffic to the video on your blog and not to the video on YouTube.

    Social Media Blog Post Sharing

Don’t hang around and wait for Google to give you traffic, go out there and promote your content and get quicker traffic. A quick, make money, blogging tip for this is to write a press release to announce that blog post. You can even reuse much of the content in the PR to save time. A press release gets into Google News and will get traffic and backlinks to your blog post. Also, share it via
Facebook and Twitter and encourage others to do the same.

Take action on these best social media strategies for more traffic to your small business blog. It is a quick and easy way to increase web traffic without having to solely rely on the Google search.

    Using Instagram for Internet Marketing

    July 23, 2012

It seems like every day that goes by there is something else in the internet marketing field that you should be using and you’d certainly be forgiven for thinking “what next

I haven’t got the hours in the day.” To a degree you’d also be right because it’s very difficult weighing up where to productively spend your available time. But today all I want to do is flag yet another marketing
opportunity that is still fairly new but growing rapidly – and if nothing else you should be aware of it, so here goes.

Yes, that’s right – Instagram is another social media thingy to add to all the others. It’ll take some time out of your busy schedule, but if you use it right, it’s well worth it.

Instagram has users and the number is growing. It’s a photo sharing app that can be used across platforms. It enables even somebody who doesn’t know which end of the camera to aim to take amazing looking pictures. Who wouldn’t love it?

The question is – How can you use it for marketing purposes? Lots of marketers didn’t know or care about it until Facebook bought it for a cool billion. Then, folks sat up and took notice.

To be honest, Instagram isn’t going to be the cornerstone of your marketing. But, if you can incorporate images into your marketing in any way, shape or form, Instagram is a great help.

    Instant Image Sharing

With Instagram, you can take pictures with your smartphone and share these pics instantly on Twitter, Facebook, Flickr, and Foursquare. The app lets you post on multiple platforms at once, which saves you considerable time if you use images in your social media marketing.

Images are great for branding on social media sites. They won’t get you sales, but they’ll get you shares, comments, and lots of exposure.

Your photos will also show up on search engines if you post them there. Optimize the photos you take, putting keywords in their hashtags, names, and descriptions.

    Get Your Comments Going

Instagram can be a great tool for engaging your audience. You can use it to get comments. Snap a picture of something new you’re using or your business is offering and ask what people think.

Most folks use Instagram to do exactly this. The only difference is that they’re not businesses; they’re just sharing cool stuff with friends. Take this approach and you’ll get the same results.

    Creative Photo Contests

An even better way to get your customers or fans involved is to have contests. Choose a theme and have them send in their shots and post them on your social media site. Give the winner (the person with the most likes, etc.) a good reward.

Another cool contest idea is to have them name a new product. Show them what it is and they send in their ideas. The great thing about this is that you’re also showing off a new product and this will means sales.

    Visual Appeal

There’s a lot that you can do with Instagram. The only tricky part is deciding how to incorporate images into your marketing plan. For some niches this isn’t so easy to do.

Just get creative. Find out what kind of images your audience likes to see. They don’t have to be directly related to your business or what you offer.

Instagram is still uncharted territory for marketers. You won’t find lots of products or articles on how to use it. But it is getting huge and you’ve got to add it to your arsenal. I recommend getting it and playing with it to get ideas.

Successful Backlink Strategies That Google Loves

    July 23, 2012

    What are Backlinks?

Backlinks are web hyperlinks placed on another person’s, or organizations’, website that link back to your site. These links allow the reader of the other website to jump to your site to read additional, relevant, information. Not only does the link remove the ‘search’ process for the reader it increases your site’s scoring with search engines, resulting in a higher placed ranking. So backlinks create good Search Engine Optimization (SEO), but only if used correctly.

    Quality or Quantity?

Be careful – if you create links with sites that are outside of your niche or sites that share little in common with yours, Google and all other search engines, will at best downgrade your ranking or, at worst, blacklist you! You have been warned: Google is red-hot on this and determined to stop people “bad linking.”

As with all things traffic, you must always aim for QUALITY not QUANTITY! 100 highly relevant backlinks are your personal Goldmine whereas 1,000 non-relevant links will bury you!

There are sites out there that have spent time (and money) linking to hundreds and thousands of sites. This approach used to be seen as a quick-fix traffic driving method but now, as search engines are demanding “relevancy” of content between linked sites, this is a definite no go area. If your site ends up like this, you WILL be treated as a link spammer. My advice? Don’t do it; it will KILL your site dead!

    How to use Backlinks

5 Simple methods That Make a Successful Backlinking Strategy

    1. Put your backlinks in articles, social bookmarking sites and blogs as well as in your signature on threads you post in any niche related forums.

    2. Google “social media sites” and add your website URL or your articles and blogs to the many social sites such as: Facebook, LinkedIn, Twitter, digg.com, StumbleUpon.com, reddit.com and your YouTube channel. Everytime you post, your backlink will be seen. The most popular of these sites are classed by search engines as “authority sites” and have a very high page ranking themselves. This is good for you!

    3. Find other blogs with a similar (relevant) theme and add comments to them. At the end of your comments add a backlink to your own site.

    4. If the page you are creating backlinks for is an article, put a link on any similar articles you have written on the topic.

    5. An easy way to start building backlinks is to use a dedicated tool. I use ‘Backlink Builder’. This software allows you to enter your keyword(s) and it gives you a list of Content Related Sites that Want Your Backlink.

Why? Because they need a constant supply of fresh, related, high-relevancy (read: quality) content from trusted sources. You! Pick sites with a good reputation and popularity wherever possible.

7 Deadly Secrets You MUST always avoid or Your site is Dead!

Look: Never, Ever submit your niche site for backlink generation if you have any suspicion that the linking sites:

    1. Have little or no relevancy to your niche.

    2. Want to link to you from every page on their website.

    3. Are “Free-for-All” link sites. These allow anyone to post any link, from any site, which are then treated as spam.

    4. Are “Link-farms” with 100 or more unrelated links on a page.

    5. Are “Bad Neighbours” – sites such as gambling, sex and drugs.

    6. Use “mirror sites” where backlinks are copied to. These ‘copy’ sites may be banned. Connect to them and you will be too.

    7. Use the rel=”nofollow” tag in their backlinks. Search engines won’t give you the credit for the Page Ranking because bots will literally “not follow” the link back to your site.

You can check this by using right-click > View Source. In the file that opens, hold Ctrl + F (Control F) and type follow into the search box. This will find all occurrences of the word ‘follow’ including nofollow.

If there aren’t any matches, then fantastic – you’re on your way! If you find nofollow, then ignore the site.

    How to Remove Bad Backlinks

If you have links you don’t want anymore, for any reason, contact the site owner and ask them to remove them. Most will, but of course some you won’t get hold of – just leave them.

How to Build a Successful Backlink Strategy

Listen: Don’t get hung up over ‘old’ or ‘unwanted’ links. Just manage your link strategy making sure you regularly add the highest quality backlinks you can. Over time, these good links will outweigh any old/bad links and it’s the good links that build your Goldmine.

N.B: For help on managing your links there are several online software products available – just Google “link checker” and choose one to suit your budget.

10 Ways to Take Your Access Database Online

    July 23, 2012

Microsoft Access, part of the Microsoft Office Suite included in the Professional edition and above, is an information management tool that allows users to store large amounts of information for reporting, analyzing, and referencing purposes.

When an Excel spreadsheet simply isn’t enough, Access can come to the rescue. After you’ve built your impressive Access database, here are ten of the ways you can take it online:

    1. SharePoint – With Access 2010 and Access Services on SharePoint, users can build web-based database applications. Anonymous users cannot access an online database created through SharePoint, greatly reducing the risk of unauthorized use. For users of Access 2007 and below, the process is significantly more complicated.
    2. Caspio’s Access Migration Kit – The Access Migration Kit by Caspio helps users migrate an Access database online with a step-by-step wizard that makes the process relatively quick and painless.
    3. Oracle SQL Developer – Oracle SQL is a free option for migrating to an online database, and includes the necessary utilities and tools to either make the move on your own or to use Oracle staff members to make the switch even easier.
    4. Hire a Specialist – For users who find themselves bewildered by the prospect of migrating to an online database, it might be best to contact a specialist who can help you determine what your needs are and the best course of action for getting your database on the web. MS Access itself can be very difficult for users to master, even with a bit of experience.
    5. Sync With Intuit QuickBase – Intuit’s QuickBase desktop application mirrors an Access database; with the sync option, changes made on the mirrored database reflect on the QuickBase server, and changes to QuickBase will be reflected on the local MS Access tables.
    6. EQL Data – OnWeb from EQL Data allows users to host an Access database on their servers, use it within a web browser, and sync with one click through the EQL plugin.
    7. Alpha Five – Alpha Five uses MS Access data to seamlessly build web applications, extending existing apps to the web and mobile devices. InfoWorld rated Alpha Five number one among programs of its ilk.
    8. Zoho – With Zoho’s plug-in for Microsoft Access, you can migrate your database into a cloud computing platform that allows for the building and modification of your database online.
    9. Upgrade to the Latest Version of MS Access – Though it is possible to get an Access 2007 or lower database online, it can be extremely frustrating and time-consuming for anyone who isn’t an absolute expert. Rather than hiring a consultant or going to extremes, it might be worth the money to simply upgrade to the latest version of Access and publish through SharePoint.
    10. Attend a Webinar or MS Access-Centered Online Class – Because so much of the process can be complicated for beginners, there are a variety of webinars and online workshops designed to improve the basic user’s understanding of MS Access and its functions.

There are a variety of options for migrating an MS Access database available, some of which are simpler than others. For novice users, webinars and workshops are highly recommended in order to get the most out of the program.

Should I Submit My Site to Web Directories?

    July 23, 2012

One tactic some people employ when promoting a site is to submit it to web directories. Some directories are free, some are paid, and some you must provide a reciprocal link back. Typically you enter your URL, provide a brief description, and place it in a relevant category. After a few days or weeks, your site will either be accepted or rejected. If accepted you will have a link from the directory pointing to your site, which is great for SEO.

Some people argue that there are no longer any benefits to submitting to web directories. However, there is no evidence to suggest that this is true, but there is good primary evidence to say that the opposite is true, which I will share with you later.

Search engines want the best sites to rank high for their users. No surprise there. One important metric they take when deciding whether a site is of a high quality is the quantity and quality of links pointing to it. They take a link pointing to a page to be a vote of confidence. So, if I like a piece of your writing and link to it for my visitors, then the search engines will see this as a vote of confidence, and will rank your page slightly higher because of it.

However, as with most things, people cottoned on and began abusing this. People began buying and selling links. Now people were gaining links through giving cash, rather than quality. Obviously Google didn’t like this, and so started a campaign against bought links. They penalized sites buying and selling links, by reducing their page rank and sometimes search engine rankings. More gently they also introduced “no follow” links where you could link to a site, but it wouldn’t pass on any credit in the eyes of Google. That way you still have opportunity to sell links on your site, without any risk of penalization.

So people reasoned that because Google doesn’t like paid links, then they don’t like directories. This is not strictly true. Google doesn’t want to award a site a vote of confidence for content, when the site linking to it didn’t. They don’t mind sites receiving links, even when paid, if there is also a vote of quality. So, if a directory accepts any link into its listings, regardless of quality, then Google can rightly conclude that this link does not represent a vote of quality, whether paid for, or not. However, if a directory charges a reasonable review fee, and only accepts quality sites, and rejects low quality sites, then it can be concluded that inclusion into this type of directory is a vote for a site’s quality.

Now the definition of a review fee seems quite generous when you look at some of the top web directories. The Yahoo directory charges €299 for a “review,” and has not been slapped by Google. Best Of The Web charges €149.99 per year, or €299.99 for permanent inclusion. You could reasonably argue that this goes beyond a review fee, and is also a fee for inclusion. However, it is what Google thinks that counts, and they don’t seem to mind as long as inclusion into a directory is based on quality, which it ultimately is on these sites.

In fact Matt Cutts, head of Google’s spam team, commented in a video on his YouTube account that he prefers quality directory links to article directory links. The reason being that a link in a directory is accepted because of the quality of the link itself. In an article directory, an article is usually accepted due to the quality of the article, not the site it links to. A top quality article in an article directory may get picked up and used in many sites, regardless of the quality of the site it links to. With this is mind, it is reasonable to assume that Google maybe one day will wage a war against links from articles. Some sites that accept guest posts do look at the site that is being linked to, but this doesn’t seem to happen all the time.

So do you get it? When link building, try to think what the search engines would view as a sign that your site is of a high quality. So, for a kick off, build a high quality site. This makes all link building easier for a start. If you have a decent quality site, then you could submit it to a few free and even paid directories. You don’t need to go mad – a handful to 10 is probably enough. Think from the perspective of a search engine – would you really just carry on endlessly giving a site credit when they keep gaining hundreds of directory links? I know I wouldn’t, and Google is way more experienced than you or I in this, and they probably wouldn’t either. This is why I always recommend that when link building, you should mix up your sources of links to create a diverse link profile.

    Final Thoughts

So, in conclusion, I would say it is well worth submitting to a few directories. Go for ones that have some page rank. I’m not talking about the home page having page rank, but the page category on which you intend your site to be listed on. Have a look at the category page and see what page rank that individual page has. Also make sure there are not hundreds of links on the same page, because the ‘link juice’ is split between all the links on a page. Take a look at the sites they already have listed. If you see any low quality spammy ones, such as Viagra, then steer well clear, even if it is a free directory. It is also worth looking at their Alexa rank, and checking that they really do have some links pointing to their directory. It is not unknown for directories to fake their page rank. However these directories usually have very few, if any back links pointing to them.

7 Key Search Engine Optimization Tips

    July 23, 2012

Good SEO is invaluable to achieving online success. Before you invest in a search engine optimization tutorial here are some tips for getting the most beneficial effects from your optimization efforts.

    1. Text is the favorite format of search engine spiders. You can rely on spiders to crawl and read a website that
has sufficient text content. If your website is heavy on graphics or dynamic content, find some way to work some basic body text into your site because spiders don’t really see Flash, JavaScript or image text.

    2. When creating content, stick to one topic for each page. Several topics on a single page confuses readers and
    leads to poorer relevancy.

    3. Use your strongest keywords early on in your copy, preferably in the first sentence. Craft your sentence in
such a way as to help spiders establish a relationship between keywords. Insert keywords and key phrases in subsequent sentences, but avoid overusing them as this might lead search engines to consider it as spam. How do you determine if you’ve overused a word or phrase? Read your copy out loud. If it sounds natural, then it’s probably all right. If, however, there is a noticeable and awkward recurrence of the keywords, then you need to modify your copy.

    4. Provide clear trails for spiders so that they can move from point A to point B and so on until they’ve covered the extent of your website that you want them to cover. A simple way to achieve this is by supplying a text-based sitemap with a link to every page on your site that you want the spiders to crawl. This is especially beneficial if your site is relatively new and has few inbound links or if your site is comprised largely of images or other format that is not easily discoverable by spiders.

Sitemaps are of benefit as well to websites that have a large volume of content pages that are not linked to each other. Although they serve more as a directional tool for spiders than for your human visitors, do consider your website’s visitors when creating your sitemap.

    5. In some cases, you may not want spiders to access certain pages on your site. This may be due to privacy reasons or, because the pages are irrelevant to the site as a whole or something else. Learn to use “robots.txt” files to instruct spiders to stay away from such content.

    6. Make your URL search-engine-friendly. Use two to three relevant keywords in your URL. Use lower case letters instead of uppercase, and hyphens instead of underscores. In general, simple, easy to remember URLs without too much punctuation are the way to go.

    7. After the URL, spiders look at the page title. Titles are a very important on-page factor when it comes to ranking because a good title conveys to spiders what your webpage is about, therefore making it easier to index. When composing titles, use two or three strong keywords that tell the topic of the page and that you want to rank for. Keep in mind that the first words of the title are given the most importance, so you want to get those keywords in at the beginning. Your title is also what is shown to searchers in search engine results pages. Google shows up to 70 characters of a page title in their results page. Be sure to make each page title unique, even if topics may be similar. This avoids confusion.

In summary, if you plan on spending a considerable amount of time and effort towards ranking your own website, then it’s always worthwhile investing in a SEO training course. This will see you really maximize your efforts.

Developer VPS: Design, Develop and Deliver Faster

    February 07, 2012

For companies and individuals who need the privacy and security of dedicated server space while still retaining some of the cost advantages of shared server solutions, virtual private servers (VPS) are a solid choice for data storage and application management. In many cases, application developers find it much more efficient to work within VPS hosting environments due to some of the unique characteristics of these computing systems.

    Starting from scratch

A developer VPS is fully customizable, allowing programmers, web designers and developers to install only those applications necessary for the proper performance of the software under development. This allows the computing environment to be completely configured around the project, making it easier to see the effects of various changes to the code. This bare-bones approach ensures that any conflicts or problems can be more quickly identified and corrected during the initial stages of the project, since these errors will not be confused with software conflicts or features of other programs.

    Cloud computing capability

VPS hosting sites offer anytime, anywhere access to the testing environment for developers, making it easier to work as a team to complete vital application development tasks. More than just a passing fad in the computing industry, cloud computing provides exceptional accessibility and makes it simpler than ever for diverse and geographically separated teams of individuals to work together seamlessly within one developer VPS environment. This functionality can also help to spur productivity and creativity by allowing developers to access their ongoing projects whenever inspiration strikes and to test their ideas in a secure, virtually risk-free environment.

    Protection for vital corporate infrastructure

Because the testing and development VPS is kept intentionally separate from other parts of the company’s IT infrastructure, any errors, crashes or other negative effects of the development process are segregated from the other ongoing operations of the corporate unit. This can eliminate any conflicts and ensure that these corporate IT assets are protected throughout the application development process.

Greater flexibility in development tool choices

Because developer VPS environments can be fully customized and need not use the same web server technologies as the company’s main server, it is possible to test and develop applications in a variety of different environments and operating systems. Depending on the type of application and the intended operating environment, developers can choose from a wide range of options including Linux or Windows environments along with an array of development platforms, each of which have their own special advantages and challenges. Multiple VPS testing environments are also possible for applications that are intended to work on a number of different platforms.

    Website development

Another advantage specifically for developing websites on a Linux is or Windows VPS the ability to see changes before they go live. Companies can even set aside multiple VPS environments for each of their websites to ensure that not only is the website backed up on a regular basis, but that any changes can be observed for a period of time before being applied to the live website. This can reduce or eliminate costly downtime and ensure that enhancements work as they are intended when they reach the end user.

    Quality assurance

After the initial testing phase is completed, the development team can submit their project, website or application to quality assurance testers within the company simply by creating logins for this purpose. Because the testing environment is also the development platform, any errors or faults in the software can be corrected on the fly without extensive copying or physical transfer of the data. This makes the entire process faster, more efficient and less costly, allowing companies to go from the initial planning phase to delivery to the customer much more quickly than before and can allow for more extensive testing while still meeting established deadlines for clients.

How Important Are WordPress Plugin Updates?

    February 06, 2012

We looked at WordPress plugins and asked how many plugins were too many to have on one blog. Another question that many may ask is: “How important are WordPress plugin updates?”

WordPress is updated frequently enough, but then you have to deal with seemingly constant updates of all of your plugins. So, what happens if you just ignore the plugin updates?

Generally speaking, your WordPress installation should continue to function properly. Nevertheless, there are a number of reasons why you should still keep your plugins update.

    1. Sometimes, new plugin versions are released to fix serious security flaws, just like many WordPress upgrades.
    2. If you just upgraded WordPress, you may need to also upgrade your plugin in order for the plugin to continue functioning properly
    3. The new plugin version may have new and improved features, and you have nothing to lose by updating.
    4. Updating literally takes seconds.
    5. You can update all plugins at once with a single click of your mouse button.

Is TPP Worse Than SOPA, PIPA & ACTA?

    February 05, 2012

First there was SOPA, then there was PIPA. The Internet beat those back. Then along came ACTA inciting protests around the world. Up next is something far worse and far more secret – the Trans-Pacific Partnership Agreement.

For those that don’t know about TPP, which is probably a large majority of the population, it’s a treaty being devised by the U.S. with eight other countries in the Pacific including Peru, Chile, New Zealand, Australia, Singapore, Malaysia, Brunei Darussalem and Vietnam.

What many people consider to be the most dangerous thing about TPP is that the negotiations for it are being conducted in absolute secrecy. The public is not being allowed to be involved with the process of this all too important treaty.

WebProNews recently had the chance to speak with Sean Flynn, IP lecturer and director of the Information Justice Program at American University. He explained to us why the negotiations were being held in such secrecy.

The secrecy is being used to try to insulate the negotiation process from broader stakeholder and public input, and primarily is being driven by the USTR. What they are trying to avoid, of course, is broad attention to the many controversial provisions in the agreement which would draw criticism from citizens and businesses in the US and other negotiating countries, making reaching an agreement more difficult. This is because the norms USTR is pursuing are not broadly representative of the full scope of interests within the US or those represented in other countries. They primarily serve the big content industries and brand name pharmaceutical companies, which dominate the formal advising process that shapes the USTR positions. As the recent SOPA debate demonstrates, there are many more interests that need to be taken into account in intellectual property legislation.

Do you agree with Flynn? Are the TPP negotiations being held in secret to prevent public scrutiny and criticism? Let us know in the comments.

Let’s back up a little bit though. The negotiations are being held in secret, but we’ve known about TPP for a while now. We’re just being fed all the wrong info. The U.S. Trade Representative Web site details TPP as a great achievement for the economies of all the countries involved.

We are delighted to have achieved this milestone in our common vision to establish a comprehensive, next-generation regional agreement that liberalizes trade and investment and addresses new and traditional trade issues and 21st-century challenges. We are confident that this agreement will be a model for ambition for other free trade agreements in the future, forging close linkages among our economies, enhancing our competitiveness, benefitting our consumers and supporting the creation and retention of jobs, higher living standards, and the reduction of poverty in our countries.

Building on this achievement and on the successful work done so far, we have committed here in Honolulu to dedicate the resources necessary to conclude this landmark agreement as rapidly as possible. At the same time, we recognize that there are sensitive issues that vary for each country yet to be negotiated, and have agreed that together, we must find appropriate ways to address those issues in the context of a comprehensive and balanced package, taking into account the diversity of our levels of development. Therefore, we have instructed our negotiating teams to meet in early December of this year to continue their work and furthermore to schedule additional negotiating rounds for 2012.

We are gratified by the progress that we are now able to announce toward our ultimate goal of forging a pathway that will lead to free trade across the Pacific. We share a strong interest in expanding our current partnership of nine geographically and developmentally diverse countries to others across the region. As we move toward conclusion of an agreement, we have directed our negotiating teams to continue talks with other trans-Pacific partners that have expressed interest in joining the TPP in order to facilitate their future participation.

President Obama also backs TPP wholeheartedly claiming the same things that the USTR does. He goes over how it will “boost our economies, lowering barriers to trade and investment, increasing exports, and creating more jobs for our people.” He goes on to say that TPP creates a trade network that will be America’s fifth-largest trading partner.

From these statements, it seems like any other trade agreement. Nothing to see here, carry on. Even the Web site’s statement on intellectual property enforcement doesn’t seem out of the ordinary. It says that it’s looking for “an effective and balanced approach to intellectual property rights among the TPP countries.” It goes on to say that they are taking all the proposals of how IP rights should be enforced and considering all their options. This doesn’t actually sound that bad. Too bad last year’s draft of the IP chapter written by the U.S. was leaked online last year.

Knowledge Ecology International ran a quick rundown of the proposed changes to IP laws in TPP. They found that consumer protection was “weak or missing.” They point out three major problems with the wording of the bill last year that should have people concerned.

Overall, the USTR proposal for the TPP intellectual property chapter would:
    (1) include a number of features that would lock-in as a global norm many controversial features of U.S. law, such as endless copyright terms.
    (2) create new global norms that are contrary to U.S. legal traditions, such as those proposed to damages for infringement, the enforcement of patents against surgeons and other medical professional, rules concerning patents on biologic medicines, disclosure of information from ISPs, etc.
    (3) undermine many proposed reforms of the patent and copyright system, such as, for example, proposed legislation to increase access to orphaned copyrighted works by limiting damages for infringement, or statutory exclusions of “non-industrial” patents such as those issued for business methods.

It’s important to note that this leak comes from late last year. The wording could have changed by now for better or for worse. We just don’t know. The absolute secrecy in which the meetings are being held prevent anybody from getting a clear picture on how things are going.

Going back to Sean Flynn, he and his colleagues caught wind of negotiations happening in West Hollywood this past week. He organized a luncheon to discuss TPP while the negotiations were going on to perhaps broker some kind of cooperation between the negotiators and IP rights specialists. As expected, it didn’t go as planned, here’s Flynn’s take on it:

Several weeks ago, global internet policy and health groups became aware that there would be an unannounced meeting of TPP negotiators this week in LA at the Sofitel in West Hollywood. Upon being informed, American University and the Computers and Communications Industry Association booked a conference room in the hotel for the first morning of the negotiation to offer a policy briefing to negotiators on concerns some experts have with a U.S. intellectual property proposal that has been leaked to the public. About an hour after the briefing was advertised to all delegations, including the host USTR, we received a cancellation of our venue by the hotel. The cancelation by Sophie Jones, Event Sales Manager, Sofitel Los Angeles stated:

“I am sorry to be the bearer of bad news but unfortunately we will not be able to move forward with your luncheon for Tuesday January 31st. It was brought to my attention that we have a confidential group in house and we will not be allowing any other groups in the meeting space that day. Again, my apologies for the late notice. Hopefully we can work together in the near future.”

After receiving the cancellation, some individuals called the hotel and were able to book a room for a claimed private event not related to the TPP. Apparently only TPP-related events were banned from the hotel at the request of an unidentified party. USTR is serving as the host of this meeting.

The film industry did not have similar problems. Not only were they informed about the TPP negotiation, but were given the opportunity to host an evening tour 20th Century Fox Studies the night before negotiations began, led by a representative of the studio’s government relations office.

The public interest briefing did ultimately take place, after being moved to a restaurant across the street from the main venue. The groups also held a public briefing at USC School of Law, a webcast and documents for which are available at: http://infojustice.org/archives/7511.

It’s obvious that the government wants public disclosure kept to a minimum. Unfortunately, it didn’t exactly happen that way. During the day of the negotiations, there were protestors outside the hotel making a stink about TPP. Thankfully, Anonymous provided pictures of the protests through imgur.

All of this begs the question of how TPP is any worse than its predecessors. We asked that very same question of Flynn:

After several leaks of ACTA text and the ensuing public outcry, especially over the internet enforcement provisions, the ACTA text improved somewhat. But one can see from the leaked TPP texts that provisions from earlier ACTA versions on issues such as internet service liability, creating a new global DMCA take down regime, and criminal enforcement for non-commercial file sharing, have entered the US proposal for TPP. There are also many provisions in the US proposal that could require alterations of US law. And the general trajectory of the US proposal remains similar to ACTA – it is all about strengthening, lengthening and increasing the aggressiveness of the enforcement of intellectual property rights, with no effort to export the balancing provisions of US law, like fair use, that have been central drivers for innovation on the internet and the protection of free speech. It is a very one-sided proposal.

The U.S. International Trade Commission, which is about as unbiased as you can get in the U.S. government, issued a report on TPP in October of last year. It outlines the problems facing the treaty and what provisions might prove to be the most controversial. Which provision is the most controversial in their eyes? You guessed it – the IP chapter.

Highly controversial; affects especially pharmaceuticals and information technology. Exporters seek provisions beyond TRIPS, such as accession to WIPO treaties. Resistance from importers, competitive producers, national health systems, NGOs. Developing countries may want to regulate bio-prospecting.

The most controversial part, however, in many opinions is the proposed copyright of buffers. For those unaware, a buffer is a small piece of data created in a computer before it plays any kind of file. While under current copyright law, a music label can claim to own the data in the MP3 for a song. These new laws would let them also claim copyright on the data buffer that was created when a user played the file. It’s worth noting that a buffer vanishes after a few seconds of creation. Think about that for a second – every single piece of data on your computer, no matter how small or inconsequential it is, would have a copyright applied to it.

After seeing all the evidence and hearing from both sides, do you agree with Flynn? Or is TPP being made out to be worse than it actually is? Let us know in the comments.

In the end, we may be all overreacting. The wording of the provisions in the current treaty could have changed for the better. The only problem is that it’s highly unlikely. The entertainment industry’s pockets are deep and they want to make sure that they have control of the media for the foreseeable future.

It’s important to note that these treaties don’t only hurt the Internet; they affect physical trade and global relations as well. While the Internet regulation part is important, we have to keep in mind the repercussions outside of our digital playground. I would implore anybody interested to read the ITC’s report on TPP and the leak of the IP chapter to form their own opinion on it.

If you’re in agreement that TPP is no good, what can you do? It’s obvious that the powers that be want as little public involvement as possible. Well, for what it’s worth, there is a submission form on the USTR’s Web site where citizens can submit comments and inquiries about TPP to the higher powers.

What’s more important is to stay informed on all changes to the treaty. The next round of negotiations will be held in Australia in March. While I’m not advocating that you travel to Australia to protest, you can make your voice be heard through a variety of ways in which Flynn points out:

People wanting to get involved should contact their representatives in Congress and write the White House to express their concerns with negotiating new intellectual property laws in secret international negotiations. The next round of negotiations will take place in Melbourne, Australia, starting March 1, 2012. EFF has an action alert out on TPP. It would be great for other groups to do the same and make it easier for people to register their concern. It should also be noted that ACTA, another international IP agreement crafted entirely in secret, is still not in force and could be defeated. The EU parliament will begin considering the issue in March, with a vote scheduled in June. And in the US, the administration is saying that it will not allow Congress to vote on whether to bind us to that controversial agreement. There is still time to halt this course and return intellectual property law-making to domestic legislatures where it belongs.

Until we get more information or another leak on TPP, I’m afraid this is all we have. Once again, it’s important to note that it could have changed. We just don’t know. Until the governments of the world decide that it’s smart business to include their citizens in any international treaties, we aren’t going to know much this or any other treaties that could be around the corner.

Are you concerned about TPP? If you are, what concerns you most from the limited information we have on it?
